Terms of Fenarrio® Five-Year Accident Replacement Program
Customers who purchased Fenarrio® car seat before the launch of this Program are also eligible to enjoy the benefits of this Program.

The Fenarrio® Five-Year Accident Replacement Program (the “Program”) is designed to provide eligible original purchasers with additional protection in the event of a qualifying road traffic accident involving an eligible Fenarrio child car seat.
This Program is a voluntary commercial benefit provided by Fenarrio. It does not affect any statutory consumer rights, statutory warranty rights, or other mandatory rights available under the laws applicable in the country of purchase.
1. Program Benefits
Subject to these Terms & Conditions, if an eligible Fenarrio child car seat is involved in a qualifying road traffic accident during the five-year Program period, Fenarrio will provide one free replacement for the affected product.
The Program follows the principle:
One accident that meets the applicable conditions of this Program. One free replacement. Five years of validity.
2. Eligibility
To be eligible for the Program, all of the following conditions must be met:

The product must be a genuine Fenarrio child car seat purchased through Fenarrio or an authorized Fenarrio sales channel.

The applicant must be the original purchaser and must provide valid proof of purchase.
-
The product must have a genuine, valid, and verifiable serial number.
-
The accident must have occurred within five years from the original purchase date.
-
The child car seat must have been installed in the vehicle involved in the accident at the time of the accident.
-
The accident must be a genuine and unintended road traffic accident.
-
The applicant must provide the documentation and information reasonably required by Fenarrio.
-
The affected child car seat must be returned or permanently destroyed in accordance with Fenarrio’s instructions.
3. Qualifying Accident
The Program applies only to genuine road traffic collisions.
The child does not need to have been seated in the child car seat at the time of the accident, provided that the child car seat was installed in the vehicle involved in the accident.
Fenarrio will assess whether the child car seat may have been exposed to impact forces that could affect its structural integrity or safety performance.
4. Required Documentation
Depending on the circumstances, Fenarrio may require:

Proof of purchase, such as an order confirmation, invoice, or receipt;

Product serial number and photographs of the product label;
-
Photographs of the child car seat after the accident;
-
Photographs showing the child car seat installed in the vehicle;
-
Photographs of the vehicle and damaged areas;
-
Photograph of the vehicle registration plate;
-
Police report or other official accident report, where applicable;
-
Insurance claim documentation or claim reference number, where applicable;
-
Vehicle repair or damage assessment documentation, where applicable; and
-
Other information reasonably required to verify the accident and product identity.
The applicant must ensure that all information and documents submitted are true, complete, and accurate.
5. Claim Period
The applicant should submit a claim as soon as reasonably practicable and normally within 30 calendar days of the accident.
Where the applicant is unable to submit the claim within this period due to insurance processing, medical reasons, or other reasonable circumstances, Fenarrio may consider a late claim on a case-by-case basis.
6. Insurance Compensation
The Program is not intended to provide duplicate compensation for the same loss.
If the accident involves motor vehicle insurance, third-party liability insurance, or other insurance that may cover the child car seat, the applicant should first report the child car seat damage or replacement need to the relevant insurer and provide the insurance outcome when submitting a claim to Fenarrio.
If the applicant states that no insurance compensation has been received, Fenarrio may require documentation reasonably demonstrating this, including:

A written insurance rejection stating that the child car seat is not covered;
-
An insurance settlement statement, compensation decision, or claim closure document showing no compensation for the child car seat;
-
Written confirmation from the insurer that the child car seat was not reimbursed; or
-
Other formal insurance documentation reasonably demonstrating that no compensation was received for the child car seat.
A customer's unilateral statement that “the insurance did not pay” will generally not be sufficient as the sole evidence of non-payment.
If the applicant has received full compensation from an insurer, the responsible third party, or another compensation provider for the loss of the same child car seat, the applicant is not eligible for a free replacement under this Program for that loss.
Where only partial compensation has been received, Fenarrio may determine whether a replacement or other support will be provided based on the circumstances, the amount of compensation received, and the relevant accident documentation.
7. Return and Destruction of the Accident-Damaged Product
Once a replacement under the Program has been approved, the affected child car seat must no longer be used.
Fenarrio may require the applicant to:

Return the affected child car seat to Fenarrio; or
-
Permanently destroy or render the product unusable in accordance with Fenarrio’s instructions.
The accident-damaged child car seat must not be sold, transferred, donated, repaired for further use, or otherwise placed back into circulation.
Fenarrio may withhold shipment of the replacement until the affected product has been returned or satisfactory evidence of permanent destruction has been provided.
8. Replacement Product
Once a claim has been approved, Fenarrio will provide:

The same model, where reasonably available; or
-
If the original model has been discontinued, is unavailable, or cannot reasonably be supplied, a Fenarrio child car seat of equivalent or higher value.
The Program does not provide a cash refund or cash alternative.
9. Replacement Frequency
Each eligible original product is entitled to one accident replacement only during the five-year Program period.
Once a replacement has been provided, the accident replacement benefit for that original product is considered fully used.
The replacement product is not eligible for another accident replacement under this Program.
10. Exclusions
The Program does not cover:

Normal wear and tear;
-
Aging or natural deterioration;
-
Damage unrelated to a road traffic accident;
-
Loss or theft of the product;
-
Damage caused by fire, flood, natural disasters, or other non-collision events;
-
Damage caused during transportation, handling, or storage;
-
Improper installation or use contrary to the product instructions;
-
Unauthorized disassembly, modification, or structural alteration;
-
Damage caused by unauthorized accessories or components;
-
Deliberately caused or staged accidents;
-
Fraudulent, false, or misleading claims;
-
Circumstances where the accident or product cannot reasonably be verified; or
-
Accidents occurring outside the five-year Program period.
The Program does not cover non-seat accessories, personal belongings, or other products damaged in the same accident unless expressly stated otherwise by Fenarrio.
11. Fraud and Duplicate Claims
Fenarrio may reject a claim if the submitted information, documents, photographs, or circumstances are false, materially incomplete, inconsistent, manipulated, fraudulent, or otherwise unreliable.
This includes, without limitation:

Deliberately causing or staging an accident;
-
Submitting photographs from another vehicle or accident;
-
Submitting an unrelated damaged product;
-
Altering or falsifying documents;
-
Submitting the same accident more than once;
-
Claiming that the product was installed in the accident vehicle when it was not; or
-
Concealing insurance or third-party compensation.
Where fraud or deliberate misrepresentation is established, Fenarrio may permanently exclude the applicant from the Program.
To the extent permitted by applicable law, Fenarrio may also seek recovery of reasonable losses or replacement costs resulting from fraudulent claims.
12. Product Transfer
The Program is available only to the original purchaser and does not automatically transfer with the product.
If the product is sold, transferred, donated, or otherwise permanently transferred to another person, the Program entitlement does not transfer to the new owner.
Second-hand purchasers are not eligible for the Program.
13. Claim Verification
Fenarrio may reasonably verify the product purchase, product identity, accident circumstances, and insurance compensation before approving a claim.
Where the information provided is insufficient to determine eligibility, Fenarrio may request additional reasonable documentation.
Submission of a claim does not guarantee approval.
14. Program Changes
Fenarrio may modify, suspend, or discontinue the Program for future purchases, registrations, or claims.
Such changes will not retroactively remove benefits already validly earned, except where permitted by applicable law.
15. Statutory Consumer Rights
This Program provides additional commercial benefits and does not replace any statutory consumer rights available under the laws applicable in the country of purchase.
If any provision of these Terms & Conditions conflicts with a mandatory legal provision, the applicable mandatory legal provision will prevail.
16. Personal Data
Fenarrio will process personal information submitted for product registration and accident replacement claims in accordance with its applicable Privacy Policy and data protection laws.
Information may be used as reasonably necessary to verify eligibility, authenticate products, assess claims, verify insurance compensation, prevent fraud, arrange product return, and provide replacement services.
