General Terms and Conditions

These General Terms and Conditions (“GTC”) apply to all contracts concluded between Fenarrio(“Seller”, “we”, “us”) and the customer (“Customer”) via https://www.fenarrio.com.
By placing an order, the Customer agrees to these GTC.
1. Scope and Provider Information
1.1 These GTC apply to all contracts concluded via https://www.fenarrio.com.
1.2 The version valid at the time of order shall apply exclusively. Any deviating terms of the Customer shall not apply unless expressly agreed in writing.
1.3 The Seller sells exclusively to consumers within the meaning of Article 2(1) of Directive 2011/83/EU and Section 13 BGB. Consumers are natural persons acting outside their trade or profession.
2. Contract Formation
2.1 Product listings on the Website do not constitute a legally binding offer but an invitation to place an order.
2.2 By clicking “Buy” or the equivalent checkout button, the Customer submits a binding offer.
2.3 An automatic order confirmation email does not constitute acceptance of the contract.
2.4 The contract is concluded only upon issuance of a shipping confirmation email.
2.5 The Seller will provide the Customer with an order confirmation and a copy of these GTC by email.
3. Order Information Accuracy
The Customer is responsible for ensuring that all information provided during checkout is accurate and complete.
4. Prices, Taxes and Shipping Costs
4.1 All prices include applicable VAT unless otherwise stated.
4.2 VAT is handled according to EU OSS (One-Stop-Shop) regulations where applicable.
4.3 Shipping costs, if applicable, are clearly displayed during checkout before order completion.
5. Delivery
5.1 Shipping Regions
Fenarrio currently ships only within selected EU countries:
• Germany

• Italy
• Spain
• Netherlands
• Belgium
• Luxembourg
• Austria
• Denmark
• Sweden
• Finland
We continuously expand our logistics coverage to serve more families across Europe.
5.2 Delivery Time
Estimated delivery time is 3–10 business days, depending on destination.
Delivery times begin after payment confirmation and are estimates only.
5.3 Unavailable Products
If a product becomes unavailable after ordering, the Customer will be informed without undue delay and any payments already made will be refunded promptly.
6. Retention of Title
Goods remain the property of the Seller until full payment has been received.
7. Payment
Accepted payment methods are shown at checkout (e.g., credit card, PayPal, Shop Pay, Google Pay). Payment is due immediately unless otherwise stated.
8. Right of Withdrawal
8.1 Statutory Right (EU)
Customers within the EU have a statutory right of withdrawal of 14 days without giving any reason.
8.2 Voluntary Extension
Fenarrio voluntarily extends the withdrawal period to 30 days from receipt of goods.
8.3 How to Exercise Withdrawal
To exercise this right, the Customer must contact:

8.4 Effects of Withdrawal
If the Customer withdraws from the contract:
• The Seller will reimburse all payments received for the returned products, including standard delivery charges, where applicable
• Refunds for statutory withdrawal follow applicable EU consumer law
• Refunds for Fenarrio’s 30-day voluntary return policy also include standard delivery charges, where applicable (free shipping orders will result in full product refund)
• Additional costs for express or non-standard delivery are not refundable
• Refunds will be processed within 14 days after receipt of returned goods or proof of return
• Refunds will be issued using the same payment method used for the original transaction unless otherwise agreed
9. Returns and Refund Conditions
9.1 Non-Defective Returns (e.g. change of mind)
• The Customer bears return shipping costs
• The refund includes product price and standard delivery charges (if any were paid)
• For orders with free shipping, only the product value is refunded (since no shipping fee was charged)
9.2 Defective or Incorrect Items
If the product is defective, damaged, or incorrect:
• Fenarrio covers return shipping costs
• The Customer is entitled to full refund or replacement
9.3 Return Eligibility
Returned products must:
• Have been reasonably used or tested (inspection or normal trial use is allowed)
• Be fully functional and free from misuse-related damage
• Include all original parts, accessories, and components
• Be returned in original packaging where reasonably possible
9.4 Incomplete or Damaged Returns
Fenarrio reserves the right to:
• Refuse the return, or
• Deduct from the refund amount
if items are missing accessories or show damage beyond reasonable inspection or testing.
10. Warranty and Legal Guarantee
10.1 Statutory warranty rights apply under EU Directive 2019/771.
10.2 All products are covered by a 2-year legal guarantee within the EU.
10.3 Customers may request:
• Repair
• Replacement
• Price reduction
• Refund (if repair/replacement fails)
11. Liability
11.1 Fenarrio is fully liable for:
• Intent and gross negligence
• Injury to life, body, or health
• Product liability under applicable law
11.2 For slight negligence, liability is limited to foreseeable damages and essential contractual obligations.
12. Promotional Offers and Vouchers
• Promotions cannot be combined unless stated
• Vouchers are non-transferable and non-refundable
• Only one voucher per order unless otherwise specified
• Valid only on https://www.fenarrio.com
13. Order Cancellation
Orders may be cancelled within 2 hours after placement, provided processing has not started.
Once shipped or processed, cancellation is no longer possible.
14. EU Online Dispute Resolution

Fenarrio does not participate in alternative dispute resolution procedures.
15. Applicable Law
15.1German law applies.
15.2Mandatory consumer rights of the customer’s country remain unaffected.
15.3The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
16. Severability Clause
If any provision is invalid, the remaining provisions remain valid. The invalid provision shall be replaced by the applicable legal rule.
