General Terms and Conditions
1. Scope and Provider Information
1.1 These General Terms and Conditions (GTC) apply to all contracts between Fenarrio (hereinafter “Seller”) and the customer (hereinafter “Customer”) via https://www.fenarrio.com.
1.2 The GTC apply exclusively in their version valid at the time of order. Deviating terms of the Customer shall not apply unless expressly agreed in writing.
1.3 The Seller sells exclusively to consumers within the meaning of Article 2(1) of Directive 2011/83/EU and §13 BGB. Consumers are natural persons acting outside their trade or profession.
2. Contract Formation
2.1 Product listings on the website do not constitute a legally binding offer but an invitation to place an order.
2.2 By clicking “Buy”, the Customer submits a binding offer.
2.3 The Seller confirms receipt of the order via automated email (“Order Confirmation”). This does not constitute acceptance.
2.4 The contract is concluded only upon shipment confirmation (“Shipping Confirmation”).
2.5 The contract text will be stored and sent to the Customer via email on a durable medium in compliance with EU law.
3. Order Data Accuracy
The Customer is responsible for ensuring that all provided information is accurate. Input errors may be corrected before final submission.
4. Prices, Taxes, and Shipping
4.1 All prices include applicable VAT according to EU regulations.
4.2 For cross-border EU sales, VAT is charged according to the OSS (One-Stop-Shop) system where applicable.
4.3 Shipping costs are clearly displayed during checkout.
5. Delivery
5.1 Delivery times begin after payment confirmation.
5.2 Standard delivery time is up to 30 days unless otherwise stated.
5.3 If goods are unavailable, the Customer will be informed immediately and any payment will be refunded.
6. Retention of Title
Goods remain the property of the Seller until full payment has been received.
7. Payment Methods
Accepted payment methods include those displayed at checkout (e.g., Shop Pay, Google Pay, credit card providers).
Payment is due immediately unless otherwise stated.
8. Right of Withdrawal
8.1 The Customer has the right to withdraw from this contract within 14 days without giving any reason, in accordance with Directive 2011/83/EU.
8.2 Withdrawal period starts from the day the Customer receives the goods.
8.3 To exercise the right of withdrawal, the Customer must inform:

8.4 Effects of Withdrawal
If the Customer withdraws:
- The Seller shall reimburse all payments received, including standard delivery costs
- Refund will be made within 14 days after notification
- Refund may be withheld until goods are received or proof of return is provided
- The Customer bears return shipping costs unless otherwise stated
9. Returns and Refund Conditions (Commercial Policy)
9.1 Fenarrio offers an extended 30-day return policy in addition to statutory EU withdrawal rights.
9.2 For non-defective returns:
- Customer bears return shipping costs
- Product must be returned in original condition
- Refund covers product price only
9.3 Defective or damaged goods:
- Return shipping is covered by Seller
- Full refund or replacement applies
10. Warranty and Legal Guarantee
10.1 Statutory warranty rights apply under EU Directive 2019/771.
10.2 Minimum warranty period is 2 years in the EU.
10.3 The Customer is entitled to:
- Repair or replacement
- Price reduction
- Refund if repair/replacement fails
10.4 Normal wear and tear is excluded where legally permitted.
11. Liability
11.1 Seller is fully liable for:
- Intent and gross negligence
- Injury to life, body, or health
- Product liability under EU law
11.2 For slight negligence, liability is limited to foreseeable damages and essential contractual obligations.
11.3 These limitations do not apply where legally prohibited.
12. Promotional Offers and Vouchers
- Discounts cannot be combined unless explicitly stated
- Vouchers are non-transferable and non-refundable
- Only one voucher per order unless otherwise specified
- Vouchers are valid only on https://www.fenarrio.com
13. Order Cancellation
Orders may be cancelled within 1 hour if not yet processed.
Shipped orders cannot be cancelled.
14. EU Online Dispute Resolution
The EU ODR platform:

The Seller is not obliged and does not participate in alternative dispute resolution proceedings.
15. Applicable Law and Jurisdiction
15.1 These GTC are governed by German law.
15.2 Mandatory consumer protection laws of the Customer’s country of residence remain unaffected.
15.3 The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
16. Severability Clause
If any provision is invalid, the remaining provisions remain in force. The invalid clause shall be replaced by the applicable statutory provision.
